SKINMEDIK.EU Terms of Use
1. General provisions
1.1. These Terms of Use, hereinafter — the Terms of Use, set out the procedure for using the website
www.skinmedik.eu, hereinafter — Skinmedik.eu, and purchasing goods.
1.2. SIA Skinmedika, registration No. 40203308251, address: Elizabetes iela 22-50, Rīga, LV-
1050, hereinafter — Skinmedika, provides the content available on Skinmedik.eu and provides
services in accordance with the Terms of Use.
1.3. The User is a legally capable natural or legal person who purchases goods from Skinmedik.eu or
uses other Skinmedik.eu services. Natural persons under 18 years of age
may use Skinmedik.eu services only with the permission of a parent or guardian, except
in cases where they have their own income.
1.4. If the User purchases goods offered by Skinmedik.eu, the Terms of Use shall be deemed
a legally binding document defining the rights and obligations of the parties
in connection with the purchase of goods, payment for them, as well as the conditions for delivery and return of goods.
1.5. If the User wishes to purchase goods from Skinmedik.eu, the User is obliged to familiarise themselves with the Terms of Use before purchasing the goods and confirm
this acknowledgement before completing the transaction. Accordingly, if the User has purchased a product from Skinmedik.eu, it shall be deemed that
the User has familiarised themselves with and agrees to the Terms of Use. At the same time, by agreeing to the Terms of Use, the User also confirms that they have the right to register and purchase
goods in the Skinmedik.eu online shop in accordance with the Terms of Use.
1.6. If the User attempts in any way to harm the operation, stability or security of Skinmedik.eu, or
otherwise fails to comply with these Terms of Use, Skinmedika has the right to cancel the User's registration
or otherwise restrict the User's access to the Skinmedik.eu online shop.
1.7. Skinmedika reserves the right to unilaterally amend and supplement the Terms of Use at any time. When the User shops on Skinmedik.eu, the Terms of Use
in the version in force at the time the goods are ordered shall apply; therefore, the User must familiarise themselves with the Terms of Use on each occasion of shopping.
1.8. Skinmedika reserves the right to change the price of goods or set a special price for goods.
Goods are sold to the User at the prices in force at the time the order is placed.
2. Personal data protection
2.1. When making a purchase on Skinmedik.eu, the User must enter their first name, surname, delivery address for the goods,
telephone number and email address, as Skinmedika requires this data to conclude a purchase agreement for the goods with the User and to ensure communication with the User, as well as
delivery of the goods to the User. This shall be deemed to mean that the User (natural person) has consented to the processing of their personal data in accordance with the procedure established by law and in accordance with Skinmedika's
Privacy Policy — to the extent that the User has provided personal data.
2.2. The User is fully and continuously responsible for the accuracy of the data provided in the registration form, as
well as for the accuracy of the data provided when making a purchase on Skinmedik.eu. If the User has provided inaccurate or incorrect data when making a purchase, Skinmedika shall not be liable for the inaccuracy of the data or
the resulting consequences and shall be entitled to demand compensation for direct losses from the User.
The User has the right to request that Skinmedika correct, delete or supplement their personal data in accordance with the client's instructions and the Privacy Policy. Skinmedika shall make appropriate data
changes during working hours, which are available on the Skinmedik.eu website.
2.3. By agreeing to these Terms of Use and the Privacy Policy, the User agrees that notifications necessary for providing order, payment and
delivery information will be sent to the email address provided.
2.4. Skinmedika guarantees that the User's data will be used only for the purposes of purchasing goods and direct
marketing.
2.5. Skinmedika undertakes to ensure the confidentiality and protection of the personal data provided by the User and undertakes not to disclose the User's personal data to third parties, except to
Skinmedika partners who provide delivery of the goods to the User or provide other services related to
fulfilment of the order, as well as to state institutions in cases stipulated by law and where there is a lawful basis for doing so.
2.6. At the time of delivery of the goods, the recipient of the goods may be asked to present an identity document in order to establish their identity.
3. Conclusion of the purchase and sale agreement
3.1. The User may purchase goods on the Skinmedik.eu website an unlimited number of times.
3.2. The purchase agreement for the goods between Skinmedika and the User shall be deemed concluded from the moment when the User, having selected the goods, has created a shopping basket and clicked on
"pay for purchase". The User is obliged to pay for the goods in accordance with the procedure and within the time limits specified in the Terms of Use.
3.3. Purchase agreements are registered and stored in the Skinmedik.eu database.
3.4. Skinmedika agrees to deliver the goods ordered and paid for by the User to the address specified in the User's
order, based on the conditions set out in Section 5 of the Terms of Use.
3.5. If Skinmedika is unable to contact the User within 3 (three) working days from the placing of the
order, the order shall be cancelled. Skinmedika shall refund the User only the amount paid for the goods; the delivery fee shall not be refunded.
3.6. In an emergency situation where, due to unforeseen circumstances, Skinmedika cannot ensure delivery of goods purchased in the Skinmedik.eu online
shop, Skinmedika undertakes to offer a similar product. If the User does not agree, Skinmedika shall refund the money paid by the User for the unavailable product as soon as possible, but no later than within 30 (thirty) calendar days from
the time the User declines the similar product.
4. Product prices and payment procedure
4.1. Product prices in the Skinmedik.eu online shop are indicated in euros; VAT is included in the price.
4.2. The User pays for the goods by credit card (when ordering the product);
4.3. If an overpayment has arisen for the goods, Skinmedika shall refund it to the User by
transfer to the bank account from which the User made payment for the goods. If the overpayment arose when using another payment method, the User must submit a written application to Skinmedika, stating the bank account number to which Skinmedika must transfer
the overpaid amount to the User.
5. Delivery of goods
5.1. When choosing the delivery method, the User undertakes to provide an accurate delivery address.
5.2. The goods may be delivered to the User by Skinmedika or its authorised representative.
5.3. The User undertakes to accept the goods they have ordered from the courier.
5.4 The delivery fee in Latvia is 2,88 EUR (two euros and 88 euro cents). If the User's order
amount exceeds 50,00 EUR (fifty euros), delivery of the goods to the User shall be
free of charge. Skinmedika reserves the right to change, at its discretion and at any time, the minimum
order amount from which delivery is free of charge.
5.5. Skinmedika shall do everything possible to ensure that the ordered goods are delivered
as soon as possible. The approximate delivery time is 1–2 (one to two) working days after completion of the purchase.
5.6. If the User is not present at the delivery address specified by the User, Skinmedika shall have the right to hand over the goods to any other adult
person present at the specified address at the time of delivery, and the User shall not have the right to make any claims against Skinmedika regarding delivery of the goods to an inappropriate person.
5.7. If delivery of the goods to the User is not possible due to the User's fault or circumstances dependent on the User (the User has provided an incorrect address, the User is not
present at the specified address, the specified address cannot be accessed, etc.), the goods shall not be sent again, but
the order shall be cancelled. In such a case, Skinmedika shall refund the User only the amount paid for the goods; the delivery fee shall not be refunded.
5.8. After receiving the goods, the User or their representative shall check whether the goods correspond to
the order. In all cases where the User receives goods whose packaging is externally damaged, the User must contact Skinmedika by email and notify Skinmedika of the defects, attaching photographs of the shipment, within 3 days of the time of delivery. Skinmedika shall not be liable for such
deficiencies in the goods that were apparent at the time of delivery but were not reported or were reported later than three days after delivery.
6. Quality of goods
6.1. The properties of all goods sold on Skinmedik.eu are indicated in the product description for each
product. Skinmedika ensures that the main characteristics of the goods sold in the Skinmedik.eu shop (information about the manufacturer, model, volume, etc.) correspond to the actual characteristics of the goods and the terms of the agreement. The criteria for the conformity of the goods with the terms of the agreement are set out in the Consumer Rights Protection Law.
6.2. Goods purchased on the Skinmedik.eu website are subject to the guarantee established in the relevant legal acts.
6.3. If, after receiving the goods, the User (within the meaning of Section 6, a consumer within the meaning of the Consumer Rights
Protection Law — a natural person who purchases goods for a purpose unrelated to their economic or professional activity) establishes that the goods do not conform to the terms of the agreement, then, in accordance with the procedure established by the Consumer Rights Protection Law, within two years
from the date of receipt of the goods, the User is entitled to submit a claim to Skinmedika regarding the non-conformity of the goods with the terms of the agreement. The User shall submit the claim to Skinmedika within one month from the date on which the non-conformity of the goods with the terms of the agreement was discovered.
6.4. In the event of goods not conforming to the terms of the agreement, the User is entitled to request that Skinmedika take one of the following actions: 1) remedy the non-conformity of the goods with the terms of the agreement; 2) replace the goods with goods that would ensure conformity with the terms of the agreement; 3) cancel the agreement and refund the money paid by the consumer for the goods.
6.5. First, the User is entitled to request that Skinmedika remedy the non-conformity of the goods with the terms of the agreement free of charge or replace the goods with goods conforming to the terms of the agreement free of charge, except where this is impossible or disproportionate (disproportionate if it causes Skinmedika costs that are disproportionate to another
6.4.alternative remedy specified in the point, taking into account the value of the goods without the non-conformity,
the significance of the non-conformity and whether use of the alternative remedy causes the consumer
significant inconvenience).
6.6. If it is not possible to remedy the non-conformity of the goods with the terms of the agreement or replace the goods with goods conforming to the terms of the agreement free of charge, the User shall be entitled to request that
Skinmedika cancel the agreement and refund the amount paid for the goods. When cancelling the agreement and
refunding the amount, Skinmedika may take into account the depreciation of the goods or the benefit gained by the User through using the goods, as agreed by the contracting parties.
6.7. In the event of a minor non-conformity of the goods with the terms of the agreement (where it does not substantially reduce the quality of the performance of the goods' basic functions or their characteristics in use and can be remedied without causing visually detectable changes to the external appearance of the goods) and such non-conformity cannot materially affect the User's ability to use the goods, the User cannot demand that Skinmedika cancel the agreement and refund the amount paid for the goods.
6.8. The User may submit objections and requests regarding the non-conformity of the goods with the terms of the agreement to Skinmedika either orally or in writing, by sending an application to Skinmedika at Baznīcas iela 20/22, Rīga, LV-1-5-, Latvia. After reviewing the objections, Skinmedika shall provide the User with a response.
7. Right of withdrawal and return of goods
7.1. If the User is a consumer within the meaning of the Consumer Rights Protection Law (a natural person who purchases goods for a purpose unrelated to their economic or professional activity), the User (consumer) may exercise the right of withdrawal in accordance with the procedure set out in Section 7 and Cabinet Regulation No. 255 of 20 May 2014 "Regulations Regarding Distance Contracts".
The consumer has the right to withdraw from the purchase agreement within 14 calendar days from the time of delivery of the product/products by submitting an application to Skinmedika regarding the exercise of the right of withdrawal, except in cases where the consumer has opened the packaging of a product which, for health and hygiene reasons, cannot be returned or the product is perishable or has a short remaining expiry period;
7.2. To exercise the right of withdrawal, the User shall send a notification electronically by email to Skinmedika's email address:. In the email notification, the User shall indicate the returned item (product name), order number and bank account number to which the User wishes to receive the money paid for the returned goods. Skinmedika is entitled to ask additional questions to clarify that the right of withdrawal applies to the product being returned. Upon receiving an application concerning the exercise of the right of withdrawal by email, Skinmedika shall immediately notify the User of the product's status; in the event of a dispute, the User is obliged to prove the fact and time limit of exercising the right of withdrawal.
7.3 After sending information about exercising the right of withdrawal, the User shall send the product back to Skinmedika by post, ensuring delivery to the following address: Baznīcas iela 20/22,
LV-1050, Rīga, without undue delay, but no later than within 14 days, or independently deliver the product to Skinmedika at the specified address within the same period. This period shall be deemed observed if the User sends the product back before the end of the 14-day period. The User is obliged to retain proof of the date on which the goods were sent back. Skinmedika warns that a product sent back by post only as far as the post office, rather than actually delivered to the specified Skinmedika address, shall not be deemed received, and Skinmedika is neither obliged nor shall it collect such a consignment from the post office.
7.4. Skinmedika shall, without undue delay but no later than within 14 days from the date on which
it received the User's application concerning the exercise of the right of withdrawal and Skinmedika confirmed
the return of the relevant product, refund the money paid by the User.
The refundable amount shall be transferred by Skinmedika to the bank account specified by the User when exercising the right of withdrawal.
7.5. Skinmedika reserves the right to withhold the refund of the amount paid for the purchase of the goods until the time when Skinmedika has received the goods returned by the User or has received confirmation from the User that the User has sent the goods back to Skinmedika, whichever action takes place earlier.
7.6. The direct costs of returning the goods shall be borne by the User.
7.7. The User may exercise the right of withdrawal subject to the following conditions:
7.10.1. the returned product(s) must be in the original packaging and the User must not have opened
the packaging of the product;
7.10.2. the product must not be damaged;
7.10.3. the product must not have been used and must not have lost its saleable appearance (labels, protective
films, etc. must be retained) (this does not apply to goods damaged at the time of delivery, in respect of which the User noted objections when confirming receipt of the goods);
7.10.4. the product being returned must be in the same condition as when it was received.
7.11. Skinmedika shall have the right to refuse to accept the product back if the time limits for returning the product were not complied with.
7.12. The User is responsible for maintaining the quality and safety of the product during the period for exercising the right of withdrawal. The User is responsible for any reduction in the value of the product if the product has been used in a manner incompatible with the principle of good faith, including being used for a purpose other than ascertaining the product's properties or operation. The products must be undamaged, must not have lost their appearance (labels must not have been removed or damaged, protective films must not have been removed, etc.) and must be unused. The product must be returned in its original packaging, in the same configuration in which it was received, with the purchase document and any other product accessories that accompanied it at the time of receipt обязательно. If the product is not complete, is damaged, untidy or inadequately packaged, Skinmedika shall have the right not to accept the product and not to refund the money paid by the User for the product.
8. Exchange of information
8.1. Skinmedika communicates with the User by email, postal address or telephone number.
The User may use any means of communication listed in the Contacts section of Skinmedik.eu.
9. Liability
9.1. Skinmedika shall be exempt from any liability in all cases where losses arise due to the User acting contrary to the procedure for using skinmedika.eu specified in the Terms of Use.
9.2. In the event of losses, the party at fault shall compensate the other party for direct losses.
9.3. Skinmedik.eu shall not be liable for discrepancies between the immaterial characteristics of the goods shown in the images in the Skinmedik shop (actual size, shape or nuances of shade, etc.) and the actual characteristics of the goods due to the parameters of the screen of the device used by the User, lighting or any other similar external circumstances.
9.4. Skinmedika shall not be liable for delays in or failure to perform obligations, or any other type of non-performance, caused by circumstances and obstacles beyond Skinmedika's reasonable control, including but not limited to strikes, government orders, warfare or
a national state of emergency, threats of terrorism or acts of terrorism, environmental or
climate anomalies, non-performance by third parties, disruptions to the internet connection,
as well as failure of computer equipment and software. In the event of such force majeure circumstances,
Skinmedika shall endeavour to eliminate the resulting delays as soon as possible.
10. Other provisions
10.1. The relationship between the User and Skinmedik shall be governed by the Terms of Use and the laws and regulations of the Republic of Latvia.
10.2. In the event of questions or disputes, the User shall contact Skinmedika's customer service by telephone or email. The parties shall endeavour to resolve all disputes through negotiations. The User who is a consumer within the meaning of the Consumer Rights Protection Law (a natural person who purchases goods for a purpose unrelated to their economic or professional activity) may exercise and protect their lawful consumer rights in accordance with the procedure established by the Consumer Rights Protection Law and the laws and regulations related thereto. If no agreement is reached, the dispute shall be referred to court in accordance with the procedure established by the laws and regulations of the Republic of Latvia.
